Yes. In accordance with the Agreement for Sale as prescribed in Form-G, if the Promoter fails to abide by the time schedule for completing the project and handing over the [Apartment/Plot] to the Allottee, the Promoter agrees to pay to the Allottee, who does not intend to withdraw from the project, interest as specified in the Rules, on all the amounts paid by the Allottee, for every month of delay, till the handing over of the possession.
Compensation/Reimbursements to the beneficiary
Section 18 of the Act provides for provisions as regards various situations in which the allottee would be compensated by the promoter due to delay in completion of the project etc.
Transfer of Title of the appartment/plot
Section 17 of the Act provides for detailed provisions regarding transfer of title of the apartment and the project to the allottee and the association of the allottees respectively.
Agreement for Sale and Promoter and allottee binding
The format of Agreement for sale to be entered into between the promoter and the allottee has been prescribed as Form-G under the Rules. This Agreement is binding on the parties. Internal flexibility as per contractual understanding could be provided in the said Agreement for sale, for determination/ insertion of other provisions as decided between the parties.
However, such provisions should not be in derogation of or inconsistent with the terms & conditions of the format of the Agreement or the provisions of the Act and rules/ regulations made thereunder.
Undertaking Amount
No. Section 13(1) of the Act prohibits the promoter from taking more than 10% of the cost of apartment without entering into a written agreement for sale, duly registered.
Promoter Liability
As per section 14(2) the promoter shall be liable for 5 years from the date of handing over of possession to the allottee towards structural defect or any other defect as specified therein.

Shri T.N.Tiwari (Tung Nath Tiwari) having been born on 08-02-1952 in District Barabanki of Uttar Pradesh and after obtaing Graduation Degree from Lucknow University, Lucknow, had joined Indian Air Force and discharging his duties there for quite considerable period of 15 years and also performing the duties of Liaison Officer, Legal Branch, Indian Air Force was retired from Indian Air Force on 31-08-1986.
While performing the duties of Liaison Officer, Legal Branch in Indian Air Force; Sh. Tiwari had dealt with various cases like Writ Petition, Civil Suits, Appeals, Special Appeals, Labour Law, Military Law including the General Court Martial proceedings and also discussion as well as obtaining opinion of Legal Remembrances (Principal Secretary Law & Justice) of the States of Uttar Pradesh and Madhya Pradesh.
After retirement from Indian Air Force; Sh. Tiwari was enrolled as an Advocate in Bar Council of Uttar Pradesh on 13-09-1986 and was subsequently practicing Legal Profession in Sessions Courts of Uttar Pradesh and Hon’ble High Court of Allahabad, Lucknow Bench as well as Hon’ble Supreme Court of India, he was selected and joined as Munsif (Re-designated as Civil Judge (Jr. Dv.)) in Uttar Pradesh Judicial Services on 06-06-1990 and thereafter performing the duties as Judicial Officer (Judge) he was retired from the Uttar Pradesh Judicial Services in the year 2005 and thereafter, again started Legal Practice in Hon’ble High Court of Allahabad, Lucknow Bench and the Hon’ble Supreme Court of India.
Sh. T.N.Tiwari had gained excellence and expertise on various types of cases like Writ Petition, Civil & Criminal Matters, Labour Law, Company Law, Service Matters as well as Taxation including the Military Law and had practiced his Legal Profession in all the relevant courts as well as Armed Forces Tribunal. Sh. Tiwari had also best expertise as Defense Council in General Court Martial.
JWO(Retd.) R.D. Sharma, Indian Air Force / Police
Sh. R.D. Sharma had served Indian Air Force for a prolonged service period of 26 years i.e. joining service in the year 1966, during his fruitful association with the Indian Air Force(Police); He was responsible to take care of the Safety & Security of the Property, Assets & Personal’s & to maintain harmonious relations between Civil Society & Administration. He was also being actively involved in carrying out various kinds of investigations as a part of his duties entrusted by the Indian Air Force. He retired from the service as Junior Warrant Officer(Police) from the Indian Air Force.
LEGALCALLIGRAPHY LLP approached Sh. Sharma to extend his expertise into various issues which will come to LEGALCALLIGRAPHY LLP from it’s clients. Sh. Sharma agreed to become a part of the Advisory / Guidance Board of the LEGALCALLIGRAPHY LLP. Sh. Ms. Jangra possesses very in-depth knowledge about the GST Law, which had transformed the complete taxation structure of India, she is also awarded the Certificate of GST Professional from the Government of India.
